BMW Financial Services (GB) Ltd underwrote tens of thousands of Personal Contract Purchase (PCP) agreements between 2007 and 2021. In late 2024, BMW Financial Services publicly reported a provision of around £70 million in relation to potential customer redress linked to past commission practices. That same year, BMW launched an FAQ page acknowledging the Financial Conduct Authority’s ongoing review of historic commission models.
If you financed a BMW through a dealership, whether a new 3 Series or an Approved Used MINI, you could be affected. This guide explains how to spot the warning signs of mis-selling, what evidence carries weight, and how to turn your concerns into a formal PCP claim. Following the UK Supreme Court ruling on 1 August 2025, most complaints will be assessed under Section 140A of the Consumer Credit Act 1974 (the “unfair relationship” test). The FCA has paused firms’ final responses on commission-related complaints until 4 December 2025 while it consults on an industry-wide redress scheme, with compensation expected to begin from 2026.
BMW compensation pot on standby
BMW’s provision does not guarantee every customer a payout, but it confirms BMW expects to compensate some drivers where individual complaints show issues such as undisclosed discretionary commission or inadequate affordability checks.
Practically, the fund signals BMW is prepared to settle well-evidenced complaints rather than contest every case, so documenting the exact gaps highlighted below is crucial if you hope to benefit. You can complain directly to BMW Financial Services for free, or use a regulated claims management company like PCP ClaimBack to assess your position, handle the paperwork, and advise on escalation.
Rapid self-check: Are you at risk?
Before digging into paperwork, skim the questions below. Tick “No” with a realistic mindset—memory fades, documents don’t.
| Question | Yes | No |
| Did the dealer hand you the SECCI before you signed? | ☐ | ☐ |
| Was proof of income recorded (payslips or bank statements)? | ☐ | ☐ |
| Was the balloon payment and mileage limit explained in writing? | ☐ | ☐ |
| Was dealer commission clearly disclosed? | ☐ | ☐ |
| Did your APR look higher than BMW’s promotional rates at the time? | ☐ | ☐ |
Two or more “No” answers mean the next sections are well worth your time.
BMW-specific warning signs
BMW car-finance complaints seen by the Ombudsman and in customer files commonly feature:
- Undisclosed discretionary commission Arrangements (DCAs) (pre-28 Jan 2021): In some cases, dealers could adjust the APR with remuneration linked to the rate (a DCA). DCAs were banned by the FCA from 28 January 2021.
- Missing affordability evidence: Files that lack payslips or bank statements may be inconsistent with FCA CONC 5 on verifying affordability.
- Balloon Payment (GFV) set above realistic resale value: If paired with a high APR, this can increase costs and, depending on the facts, may contribute to unfairness under CCA s.140A.
Any one sign may justify a complaint; a combination strengthens it further.
Evidence pack: what to gather and why
Collecting these records upfront makes your complaint harder to dismiss.
| Document | Why it matters | Red-flag clue |
| Signed finance agreement & SECCI | Locks in APR, balloon, and any commission wording | Commission section blank or vague |
| Dealer invoice or order form | Shows cash price & dealer incentives | “Finance bonus” or “commission adj.” noted |
| Credit-application form | Contains stated income/outgoings | Round numbers (e.g., £3,000) with no supporting evidence |
| BMW settlement letter | Lists total interest paid (if settled/early) | Interest appears high relative to term/amount |
From evidence to complaint: a step-by-step process
The rights outlined above take effect only when applied methodically. Follow the four steps below to create an evidence bundle that BMW Financial Services—or, if necessary, the Financial Ombudsman—will find difficult to dispute.
- Request your file.
Email customerservices@bmwfs.co.uk (or use BMW FS’s online SAR portal) with a Subject Access Request. Ask for the credit application, SECCI, any commission disclosure/invoice, and underwriting/affordability notes. Firms generally have one month to respond to DSARs. - Match evidence to potential breaches.
Compare declared income with payslips; check whether commission appears or is clearly explained in the SECCI; note discrepancies between the quoted APR and the signed APR. - Submit a formal complaint to BMW FS.
Explain what went wrong and reference CCA s.140A and relevant FCA CONC rules (commission transparency and affordability). Note: for commission-related complaints, the FCA has paused final responses until 4 December 2025; your complaint will be logged and preserved. - Escalate to the Financial Ombudsman Service if needed.
Once a final response is issued—and if you disagree—you can refer to the FOS for a free, independent, binding decision. Be mindful of FOS time limits stated in the final-response letter.
Staying organised, copying everything you send and receive, keeps the process smooth.
