Financing a BMW or MINI on a Personal Contract Purchase (PCP) should be straightforward: predictable monthly payments, a clearly stated balloon (Guaranteed Future Value) and the freedom to keep, swap or hand back the car at the end. BMW Financial Services (GB) Ltd writes most of the PCP agreements sold through UK BMW and MINI dealerships, so it must follow strict consumer-credit rules. If those rules were bent or ignored, say, because commission was hidden or affordability checks were rushed, you may be able to make a car finance claim. (Post-1 August 2025, most complaints are considered under Consumer Credit Act 1974 s.140A. The FCA has paused firms’ final responses on commission-related complaints until 4 December 2025 while it consults on a redress scheme.)
Rule-books that protect BMW PCP customers
Every successful mis-selling complaint relies on one or more of these three frameworks.
| Framework | What it covers | Why it matters for a BMW PCP claim |
| Consumer Credit Act 1974 | Early settlement, voluntary termination (s. 99) and the Section 140A “unfair relationship” test. | Lets an adjudicator order BMW FS to reduce or refund interest and charges if the deal is unfair. |
| FCA Consumer Credit Sourcebook (CONC) | Affordability checks, commission disclosure, complaint-handling standards. | Any breach, e.g. missing income evidence or unclear commission disclosure, can support a complaint. |
| Financial Ombudsman Service (FOS) | Free, binding decisions once BMW FS issues a final response (or after the FCA pause ends). | FOS award limits (editorial standard): up to £415,000 for acts/omissions on or after 1 Apr 2019 and £190,000 for earlier issues. |
Taken together, these rule-books give you the key legal levers you need.
Your rights before signing a BMW PCP
BMW dealers must build four safeguards into the sales process. If any were skipped, your claim already has a foundation.
- SECCI delivered in good time. The Standard European Consumer Credit Information sheet must include the APR, balloon and any commission reference.
- Verified affordability. Under CONC 5, income and essential outgoings should be evidenced, not guessed.
- Up-front commission disclosure. Until 28 Jan 2021, dealers could raise your APR to earn discretionary commission (DCAs). If that wasn’t clearly explained, your informed-choice right may have been undermined.
- Cooling-off awareness. You have 14 days to cancel once you receive the written agreement; dealerships should highlight this right.
If just one safeguard failed, note it—it may become a key complaint point.
Your rights during the agreement
| Right | Why it matters |
| Early-settlement rebate | You can clear the finance at any time; BMW FS must refund any unearned interest fairly (CCA ss.94–95). |
| Voluntary termination | After repaying at least 50 % of the total amount payable (including the balloon payment), you can hand the car back (CCA s.99). |
| Fair treatment in arrears | CONC 7 requires tailored support such as payment plans—not aggressive default notices. |
| Accurate credit-file data | Errors must be corrected promptly; unresolved mistakes may support an unfair-relationship claim. |
Each breach you document adds weight to a future complaint.
Your rights after the agreement ends
- Section 140A unfair-relationship claim. Courts or FOS can order BMW FS to refund interest, fees and (where applicable) undisclosed commission.
- Time limits. For court claims under s.140A, a six-year period generally runs from when the credit relationship ends (not from the start date). FOS referrals follow its own time rules once a final response is issued.
- FOS compensation caps. Up to £415k (post-1 Apr 2019) or £190k (pre-1 Apr 2019) as noted above.
Self-check: did BMW FS breach your rights?
| Question | Yes | No |
| Did you receive the SECCI with enough time to read it? | ☐ | ☐ |
| Was proof of income recorded? | ☐ | ☐ |
| Was dealer commission clearly disclosed? | ☐ | ☐ |
| Were balloon and mileage limits explained in writing? | ☐ | ☐ |
| Was your APR markedly higher than BMW adverts at the time? | ☐ | ☐ |
If you tick “No” to two or more questions, move to the process below—your claim may meet the usual threshold for investigation.
From evidence to complaint: a step-by-step process
Follow these four steps to build an evidence bundle BMW Financial Services, or the Ombudsman, will find hard to dispute.
- Request your file. Email dataprotection@bmwfs.co.uk asking for the credit application, SECCI, any commission disclosure/invoice and underwriting notes (make a Data Subject Access Request).
- Match evidence to breaches. Compare declared income with payslips; check whether commission appears or is clearly explained on the SECCI; highlight APR discrepancies.
- Submit a formal complaint to BMW FS. Quote the specific issues and reference Section 140A and the relevant CONC rules. (Note: final-response deadlines on commission complaints are paused until 4 Dec 2025.)
- Escalate to FOS if necessary. If BMW Financial Services rejects your complaint—or doesn’t respond once the pause ends—you can submit your evidence to the FOS for a binding decision.
